The Second Annual House Full of Windows Sweepstakes (“Sweepstakes”) begins at 12:01 a.m. Eastern Time (“ET”) on February 26, 2007 and ends at 11:59 p.m. ET on April 9, 2007.
There are two ways to enter:
1. Internet Method: Visit www.dannylipford.com during the Sweepstakes Entry Period and complete the Sweepstakes questionnaire and registration form by following the instructions on the web site. Online entries must be received during the Sweepstakes Entry Period to be eligible for the random drawing. Limit: One online entry per person or e-mail address per day. Online entrants subject to all notices posted online including but not limited to privacy policy. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the “Authorized Account Holder” of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
2. Mail-in Method: To enter by mail, hand print your full name, complete home address, phone number, e-mail address (if available) on a postcard and mail to: The Second Annual House Full of Windows Sweepstakes, c/o Today’s Homeowner with Danny Lipford, 75 Midtown Park East, Mobile, AL 36606. Mail-in entries must be postmarked by April 9, 2007 and received by April 16, 2007. Today’s Homeowner with Danny Lipford, d.b.a. Remodeling Today, Inc. and Simonton Windows, Inc. (the “Sponsors”) are not responsible for lost, stolen, fraudulent, late, mutilated, incomplete, altered, postage due, illegible or misdirected mail/entries.
All entries become the property of the Sponsors. The Sponsors are not responsible for acknowledgement of entries.
Sweepstakes is open only to legal residents of the contiguous United States and the District of Columbia age 18 or older at time of entry. Void in Alaska, Hawaii, Puerto Rico and where prohibited or restricted by law. All federal, state and local laws and regulations apply. Employees and immediate family members of the Sponsors, Inc., Fortune Brands, Inc. and all of its subsidiary companies, and those entities’ advertising, promotion, marketing and public relations agencies are not eligible to enter. By entering, you agree to these Official Rules and the decisions of the judges, which are final and binding in all respects. Entrants agree to be bound by the terms of these Official Rules. The laws of the state of Alabama will govern this Sweepstakes. By entering, entrant releases the Sponsors, Inc., Fortune Brands, Inc. and all of its subsidiary companies, along with their respective parent companies, affiliates, subsidiaries and anyone working on related to promotion, advertising and promotional agencies from any and all liability from damage or injury resulting from acceptance, receipt, use and enjoyment of prize.
One Grand Prize will be awarded of Simonton StormBreaker Plus white vinyl windows for one residence owned or rented by winner. If winner is renting home, s/he will need to obtain prior written permission from his or her landlord to install windows in rental unit or s/he will forfeit all rights to the prize. Prize is limited to 20 Simonton StormBreaker Plus window units with a maximum retail value of $16,000; actual number of units awarded may be less than 20 if residence contains less than 20 windows. No substitution, transfer or assignment of prizes is permitted. All incidentals and taxes on the prize, including sales and income taxes, are the sole responsibility of the winner.
Any window removal and repair costs prior to installation of the windows plus the costs associated with installation of the prize windows are the sole responsibility of the winner. Windows will be shipped to Simonton distributor closest to winner’s residence. The Sponsors are not responsible for any damage to the windows after the winner picks-up windows from the Simonton distributor. Winner will be responsible for arranging and paying for pick-up of windows from the distributor and delivery to winner residence location. Simonton will provide a $500 stipend check to winner to offset cost of delivery to the residence after windows have been delivered to the residence.
Winner is responsible for securing exact measurements of the window units and submitting said measurements and all window unit specifications to Simonton Windows, Inc. within 180 days after drawing date. Winner agrees to have all window units installed, at winner’s expense, within 60 days of receiving said window units. Odds of winning depend on the number of eligible entries received during the Sweepstakes Entry Period. No cash in lieu of prize. Total retail value of the prize is estimated at $16,500 and will vary based on the size and style of window units required for the residence of the winner. If actual value turns out to be less than stated prize value, the difference will not be awarded in cash.
Winner will be selected by a random drawing from all eligible entries on or about April 27, 2007. Winner will be notified by mail, overnight carrier, email and/or telephone on or before May 1, 2007. Winner will be required to complete and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (where permissible) within 14 days of date specified on notification or an alternate winner will be selected. If Affidavit/Release is returned as undeliverable, it will result in disqualification and the prize will be awarded to an alternate winner in a separate random drawing. If winner is otherwise eligible under these official rules, but is less than the age of majority in his or her state of primary residence, the prize will be awarded in the name of winner’s parent or legal guardian who will be required to execute Affidavit/Release on minor’s behalf.
The name of the winner will be posted on www.dannylipford.com on or about May 25, 2007. Name of the winner may also be attained by sending a self-addressed stamped envelope by May 25, 2007 to: Second Annual House Full of Windows Sweepstakes Winner, c/o Today’s Homeowner with Danny Lipford, 75 Midtown Park East, Mobile, AL 36606.
Where permitted by law, winner agrees to grant the Sponsors the right to print, publish, broadcast and use worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner’s name, portrait, picture, voice, likeness and biographical information as news or information and for advertising and promotional purposes without additional consideration; and further without additional compensation, appear for, or provide biographical information for use in, any presentation or other activity which may include filming/audio/video/electronic or other recordings and/or interviews, as may be determined from time to time by the Sponsors. Winner agrees that this may include the taking of both “before” and “after” photography and/or filming at the residence that will gain the prize. Failure to make such appearances or grant such rights may result in disqualification with an alternate winner selected.
The Sponsors reserve the right to disqualify any individual or individuals it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or web site; to be in violation of the Official Rules; or with intent to annoy, abuse, threaten or harass any other person. The Sponsors will prosecute any fraudulent activities to the full extent of the law. The Sponsors reserve the right, at either company’s sole discretion, to cancel this Sweepstakes and select winner from all eligible entries received prior to cancellation.
The Sponsors are not responsible for any incorrect or inaccurate information, whether caused by web site users, or tampering or hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site. The Sponsors are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. If for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Sponsors could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the winner from all eligible mail-in entries and Internet entries received for the drawing prior to that action taken. In no event will the Sponsors, Fortune Brands, Inc. and all of its subsidiary companies along with their respective parent companies, affiliates, subsidiaries and anyone working on related to Sweepstakes, advertising and promotional agencies, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of Internet site www.dannylipford.com or the downloading from and/or printing of material downloaded from said site.
As a condition of participating in this Sweepstakes, entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the City of Mobile, Alabama, having competent jurisdiction, which Court shall apply the laws of the State of Alabama without regard for doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
